1. Introduction.

Welcome to Visavior.com (operated by Zenvior Ventures Private Limited) – an AI-powered SaaS platform for visa agencies ("Service") . These Terms and Conditions ("Terms") govern your ("Agency") access to and use of Visavior. Agencies may create sub-accounts for their visa applicants ("Customers") . By registering or using the Service, you (the Agency) agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions. In these Terms:

• "Agency" means a visa processing company or agent subscribing to Visavior.
• "Customer" means an individual visa applicant whose data is managed by an Agency via Visavior.
• "Visavior," "we," “us," or "our" means Zenvior Ventures Private Limited, provider of Visavior.
• "Services" mean all features of the Visavior platform (including AI-powered document data extraction, form-filling tools, and subdomain websites) provided to Agencies.
• "User Data" means all data uploaded or entered by an Agency or its Customers (such as passports, IDs, insurance, tickets, financial documents, etc.).

3. Account Registration and Use.

• Agency Account. An Agency must register and maintain an account to use Visavior. The Agency is responsible for the accuracy of all information it provides and must promptly update any changes. The Agency is responsible for maintaining the confidentiality of its login credentials. The Agency shall ensure that only authorized employees or representatives (“Users”) access its account. Each login may only be used by the registered Agency and its designated Users. Sharing credentials is prohibited.
• Customer Access. Agencies may create Customer sub-accounts allowing visa applicants to log in at {agency-handle}.agency.visavior.com. Customers may upload and manage their own documents or view documents uploaded by the Agency. Agencies are responsible for any Customer activity under their account.
• Third-Party Credentials. If the Service integrates with third-party accounts (e.g. email or messaging services), you authorize Visavior to access such accounts for providing the features you request.

4. Description of Services. Visavior provides:

• AI Data Extraction. We use AI to extract structured data from uploaded documents (passports, identity proofs, financial statements, etc.) to facilitate visa form-filling. You acknowledge that we use third-party AI services; such providers have their own terms. Visavior does not guarantee the accuracy of AI output . Agencies must verify all extracted data before submission. Because AI-generated content may be incorrect or incomplete, Agencies remain solely responsible for reviewing and correcting any information (see Accuracy Disclaimer below).
• Agency Subdomain and Website. Each Agency receives a branded subdomain [e.g. {agency-handle}.agency..visavior.com] where it can list its services, marketing content, and communicate with Customers. Customers can log in to this site to view their visa applications and documents.
• Communications. The platform may send notifications or messages (Email, SMS, WhatsApp) to Customers on behalf of the Agency. Agencies are responsible for the content of any messages and compliance with applicable communication regulations. We disclaim any liability for third-party messaging services and associated costs.

5. Data Ownership and Privacy.

• Data Ownership. As between Visavior and the Agency (or its Customer), you retain all ownership rights in your User Data. Visavior acquires no ownership of your documents or extracted data. You grant Visavior a limited, royalty-free license to use and process your User Data solely to provide the Services and fulfill our obligations . For example, we process documents to populate forms, and we may store them encrypted on our storage service.
• Controller / Processor. The Agency (and its Customers) are data controllers for User Data; Visavior acts as a data processor . We will process User Data only on your behalf and under these Terms. You are responsible for complying with all applicable data protection laws (e.g. India’s IT Act and rules) regarding User Data.
• Confidentiality. We treat all User Data and Agency account information as confidential . We will not disclose your data to third parties except as needed to provide the Services or as required by law. Visavior maintains access logs and tracks document uploads, downloads, and views for security and audit.
• Security. We employ industry-standard measures to secure User Data. All documents are stored in encrypted form on Third-Party Cloud Provider. Visavior follows RBI-recommended security practices and will maintain adequate information security infrastructure. However, no system is completely secure; you must maintain your own backups and secure credentials.

6. Accuracy Disclaimer and AI Use.

• No Warranty of Accuracy. The AI-powered extraction and form-filling tools are provided “as-is” without any warranty of accuracy . Because AI can “hallucinate” or produce errors, you agree to carefully review all outputs. You acknowledge and accept that using AI carries risks of inaccuracy . Visavior is not liable for any errors or omissions in extracted data or documents. You assume full responsibility for verifying that all information is correct before submission.
• Use of Third-Party AI. The Services may integrate third-party AI or other tools (e.g. AI for OCR/data extraction). Use of such tools is subject to their terms. By using Visavior, you consent to necessary transfer of your data to these providers for processing. Visavior disclaims any liability for the functionality, availability, or reliability of third-party services. We do not guarantee uninterrupted access to AI features.
• Compliance and Conduct. You must not use the Service in violation of any law or to upload illegal content. In particular, you agree not to upload forged documents or infringe third-party rights. You are responsible for the legality of visa applications and documents prepared using our Service.

7. Subscription Fees and Payment.

• Fees. Agencies subscribe to Visavior for a recurring fee (monthly/annual) as agreed in your Order. Subscription fees are exclusive of taxes and must be paid in advance. We do not currently process payments from the Agency’s Customers through the platform; agencies remain responsible for collecting any visa or service fees from Customers. If we introduce customer payment features later, such transactions will be subject to additional terms.
• Payment Gateway Compliance. We comply with applicable RBI guidelines for payment gateways and aggregators. We will maintain and disclose comprehensive information about fees, policies and terms on our website . All credit card and payment data is handled securely via PCI-DSS–compliant providers.
• Refunds and Cancellation. Subscription fees are non-refundable except as required by law. Agencies may cancel their subscription by providing notice as per your subscription agreement. We may suspend or terminate your access for non-payment or breach of these Terms.

8. Intellectual Property.

All software, technology, and content provided by Visavior are the exclusive property of Zenvior Ventures Pvt. Ltd. and its licensors. Agencies and Customers are granted a non-exclusive, non-transferable license to use the Service per these Terms. You shall not copy, modify, or reverse-engineer the platform. All trademarks, logos, and brand names used in the Service belong to their respective owners.

9. Confidentiality.

Agencies must keep their account credentials secure and not disclose any non-public information about Visavior or its clients. Likewise, Visavior will keep your confidential information (e.g. account details, business data, Customer details) strictly confidential. Both parties agree not to use the other’s Confidential Information except as needed to perform their obligations.

10. Third-Party Services and Links.

Visavior may provide links to or integrations with third-party services (e.g., government visa sites, messaging platforms). Use of any third-party service is subject to that service’s terms. Visavior is not responsible for the content, availability, or policies of any third-party website or service. You agree that Visavior will not be liable for any issues arising from your use of third-party services.

11. Limitation of Liability.

To the maximum extent allowed by law, Visavior (and its directors, employees, partners) shall not be liable for any indirect, incidental, special or consequential damages (including lost profits or data) arising out of or related to the Service. Our total liability for direct damages in any case will not exceed the amount of subscription fees you paid in the prior 12 months. Visavior disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose. You use the Service at your own risk, relying on any information or features only after your own verification.

12. Indemnification.

The Agency agrees to indemnify, defend, and hold harmless Visavior from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of: (a) your or your Users’ misuse of the Service; (b) your violation of these Terms or any applicable law; (c) any inaccuracy or omission in information you provided; or (d) infringement of any third-party rights by content you upload. This indemnification obligation survives termination of the Terms.

13. Termination.

We may suspend or terminate your access (in whole or part) if you violate these Terms or any applicable law. You may terminate your account at any time by contacting support. On termination, you must stop using the Service and delete all copies of documentation. Sections on Data, Liability, Indemnity, and Disputes will survive termination.

14. Changes to Terms.

We may update these Terms from time to time. We will notify you of significant changes (e.g. via email or in-app notice). Continued use of the Service after changes indicates your acceptance of the new Terms. Please review this page periodically for updates.

15. Governing Law and Dispute Resolution.

These Terms are governed by the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

16. Acknowledgment

By using Visavior’s Services, the Agency and its Users acknowledge that they have read, understood, and agreed to these Terms and Conditions, including all disclaimers and limitations described above.

• Entire Agreement: These Terms constitute the entire agreement between you and Visavior regarding the Service, superseding any prior agreements.
